  2. “Content”: All information on this Site (texts, images, videos, audio, logos, UI, databases, programs, documents, layouts, and metadata).
  3. “IP Rights”: Copyrights (incl. rights under JP Copyright Act Arts. 27 and 28), trademark rights, design rights, patents/utility models, trade secrets, and protected trade dress.
  4. “Third-Party Marks”: Corporate names, trademarks, service marks, logos, characters, and titles owned by third parties.

2. Ownership of IP Rights

  1. All IP Rights in and to the Content belong to the Company or rightful owners. Except as explicitly permitted by law, any reproduction, public transmission, distribution, assignment, lending, adaptation, modification, or inclusion into machine-learning datasets is prohibited without prior written consent.
  2. Quotations must strictly satisfy Article 32 of the Japanese Copyright Act (fair practice, within a justifiable scope, ancillary/subordinate to the main work, with proper source attribution).
  3. Automated acquisition (scraping/crawling/data mining) is allowed only within the scope expressly authorized in writing (including qualified electronic signatures).

3. Trademarks and Attribution

  1. “Mirrativ” is a registered trademark or trademark of Mirrativ Inc.
  2. The Company operates as an officially contracted Platinum Partner Office under a valid service agreement with Mirrativ Inc., conducting streamer recruitment, education/management, and reward distribution within the authorized partnership framework.
  3. The Site is an official operation site of the Company as a contracted partner office. The Company is not a subsidiary or affiliate of Mirrativ Inc.; operational policies for recruitment and training are independently designed and implemented within the scope of the partnership.
  4. Third-Party Marks may be used descriptively for source identification, interoperability, or comparative references, strictly avoiding confusion as to source, sponsorship, or endorsement.

4. Disclaimers

  1. While the Company endeavors to ensure accuracy, completeness, and timeliness, the Content is provided “as is” and “as available,” without warranties of any kind (including fitness for a particular purpose, non-infringement, or merchantability) to the maximum extent permitted by law.
  2. The Company shall not be liable for any losses arising from actions taken in reliance on the Content, except in cases of willful misconduct or gross negligence by the Company.
  3. The Company assumes no responsibility for any external websites linked from this Site.

5. Limitation of Liability; Indemnification

  1. For breach or tort by the Company (excluding willful misconduct or gross negligence), liability is limited to direct and ordinary damages. The aggregate cap equals the total fees actually received by the Company from the user in the month when the cause arose; if no fees apply, the cap is JPY 50,000.
  2. If a user causes a dispute with a third party by breaching this page or the Site’s rules, and the Company incurs damages or costs (including reasonable attorneys’ fees), the user shall defend, hold harmless, and indemnify the Company to the extent permitted under the Consumer Contract Act of Japan.

6. Prohibited Conduct

  1. Unauthorized reproduction, redistribution, secondary use of Content for machine-learning, or removal of metadata.
  2. Acts creating confusion regarding source or sponsorship, or producing substantially similar trade dress in violation of the Unfair Competition Prevention Act of Japan.
  3. Overloading servers, probing vulnerabilities, bypassing authentication, or disabling access controls of the Site.

7. Notice & Takedown

For suspected IP infringement, defamation, misleading representations, or other legal concerns, please contact the following window with sufficient evidence. Where lawful and appropriate, the Company will promptly investigate and may suspend access, remove, or replace materials.

Jurisdiction & Law

Governing law: Japan. See Section 9 for courts.

9. Governing Law and Jurisdiction

  1. This page shall be governed by the laws of Japan.
  2. Any dispute between the Company and users arising from or relating to the Site shall be subject to the exclusive jurisdiction of the Wakayama District Court or the Wakayama Summary Court as the court of first instance, depending on the amount in controversy.

10. Amendments

The Company may amend this page without prior notice in response to changes in laws, case law, platform terms, or business operations. The amended version becomes effective upon posting on the Site.

11. Severability; Survival

  1. If any provision is held invalid or unenforceable, the remainder shall continue in full force. Such provision shall be modified to the extent necessary to be valid and enforceable.
  2. Provisions on IP rights, disclaimers, liability limits, governing law/jurisdiction, and indemnities shall survive termination of use.
